Resolution to the ORP Mandate

On August 16, a group of MSP stakeholders convened at the Ohio Statehouse to draft an Ohio House and Senate Bill amendment that will give Ohio MSP Occupational TherapistsPhysical TherapistsSpeech Language Pathologists and Audiologists the authority to “Order, Refer, Prescribe” (ORP) IEP services in the Ohio Medicaid School Program. This was a joint effort by the Ohio Department of MedicaidOhio Department of Education, the Offices of Senator Lehner and Representative DeVitis, government relations firm Byers Minton, State Board of Education member Michael Collins, OAME President Bryan Williams, and Healthcare Billing ServicesWhile this legislation is in process, ODM will continue to accept and process MSP claims as they have in the past. ODM will be making the necessary changes to the Medicaid Enrollment System that will allow MSP therapist to enroll as “ORP Only” providers. Your therapists should continue to assess and provide their IEP services to students as they have in the past. 

Districts do not need to obtain an outside ORP for any MSP services other than nursing services.

This solution is not based on an interpretation of an existing rule, but is a change to the Ohio Revised Code that will put an end to any confusion around the ORP issue for the Ohio Medicaid School Program. We want to address future MSP issues in this same manner, by pulling together a bipartisan team of stakeholders, and working together for a positive solution. Resolving this ORP issue will allow us now to focus on moving the program forward with initiatives like Program Integrity, Expansion, Efficiency, and so on.

We are appreciative of our partners at the Ohio Department of Medicaid and the Ohio Department of Education, but I also want to point out the role that Bryan Williams at OAME (Ohio Alliance for Medicaid in Education) played in bringing everyone to the table to resolve the ORP issue. I am excited about working with Bryan and Mike Collins, as we rebrand OAME and help continue to grow our current $72-million-dollar program.

Thank you for your patience as we worked for a positive outcome to the ORP issue. We will keep you abreast of any additional information on ORP. I understand that ODM will be issuing something soon regarding ORP and the CMS extension request.
